The NYPD said a 55-year-old man has been arrested following an assault outside a restaurant in Fordham Heights.
Police said on Friday, Aug. 12, at around 10.45 p.m., cops responded to a 911 call regarding a man who had been assaulted in front of the “Fuego Tipico Restaurant” located at 163 East 188th Street.
A police spokesperson said, “Upon arrival, responding officers discovered a 52-year-old male victim unconscious and unresponsive on the ground with trauma to his head.”
They said upon further investigation, it was found that the victim exited the restaurant, stopped and observed a group of people talking, at which point an unidentified person exited the restaurant, put on a pair of gloves, and positioned himself behind the victim.
According to police, without prior conversation or any altercation, the person wearing the gloves punched the victim in the face and then returned to the restaurant, and later left to parts unknown. “The victim sustained a skull fracture, broken cheek bone and bleeding on his brain,” a police spokesperson said.
EMS were alerted and arrived at the location and transported the victim to Jacobi Medical Center, where he is listed in critical but stable condition, police said. The investigation is ongoing.
The assailant is described as an adult male, has a medium complexion and a medium build, and was partially bald. He was last seen wearing a black pants, a black T-shirt and gloves.
A photo and video of the assailant, taken at the incident location, are attached. Pursuant to an ongoing investigation, police later confirmed that Bui Van Phu, 55, of Creston Avenue in Fordham Manor has been arrested in connection with the incident, and has been charged with attempted murder.
A person arrested and charged with a crime is deemed innocent unless and until convicted in a court of law.
Bronx District Attorney Darcel D. Clark, later issued a statement after the defendant was reportedly released from custody without bail, but has since been re-arrested.
