The NYPD announced on May 8 that pursuant to an ongoing investigation, a 26-year-old man was arrested and charged with murder following the fatal shooting of Johnny Gaston on Burnside Avenue in University Heights in mid-December 2022. He is the second man arrested in connection with the case.
As reported, the NYPD had been asking for the public’s assistance locating and identifying the people seen in the attached photos who they said were sought for questioning in connection to the armed robbery and shooting that occurred on Dec. 15, 2022, in front of 1920 Osbourne Place in University Heights, and which resulted in the death of 32-year-old Gaston.
The fatal victim was found in front of 189 Burnside Avenue, also located in University Heights.
The NYPD launched a murder investigation after the 32-year-old died from gunshot wounds while another person, who was also shot during the incident, was hospitalized and was previously reported as being in stable condition.
An NYPD spokesperson initially reported that officers responded on Thursday, Dec. 15, at 10.02 p.m. to a 911 call regarding a man who had been shot in front of 189 Burnside Avenue.
“Upon arrival, police discovered two individuals shot. Victim #1, a 32-year-old male, was shot in the head and removed to St Barnabas Hospital where he was pronounced deceased,” the spokesperson said.
“Victim #2, a 27-year-old male, was shot in the groin and removed to St. Barnabas Hospital in stable condition,” the spokesperson added. “There are no arrests and the investigation is ongoing.”
The deceased was later identified as Gaston, 32, from the Foxhurst section of the South Bronx.
As reported, pursuant to what was described at the time as an ongoing investigation, Gibran Guerrero, 19, from Mt. Hope was arrested on Tuesday, Jan. 3, at 7 p.m. at the 46th Precinct. He was charged with murder, attempted murder, manslaughter, assault, robbery, and criminal possession of a weapon (a loaded gun). The investigation remained ongoing.
On May 8, police said Yorvin Gomez, 26, of Davidson Avenue from the Morris Heights section of The Bronx was also charged with murder, manslaughter, and criminal possession of a weapon (a loaded firearm) in the 46th Precinct.
A person arrested and charged with a crime is deemed innocent unless and until convicted in a court of law.
