Bronx District Attorney Darcel D. Clark announced on Tuesday, Dec. 14, that a Bronx man has been charged with attempted murder and additional offenses for a shooting that wounded a woman as she pushed her two-year-old daughter in a stroller in the Marble Hill neighborhood.
Clark said, “The defendant acted recklessly with indifference to life when he fired a gun on a Bronx street. The bullet did not strike his target; instead it struck a woman who was pushing her two-year-old daughter in a stroller.” She added, “No person, let alone a mother and her child, should have to fear gunfire while walking down the street.”
Clark said the defendant, Cody Ball, 27, of West 225th Street in the Bronx, was arraigned on Tuesday before Bronx Supreme Court Justice Efrain Alvarado.
The charges comprised attempted murder in the second-degree, attempted assault in the first-degree, two charges of second-degree criminal possession of a weapon, third-degree criminal possession of a weapon, first-degree reckless endangerment, second-degree assault, attempted assault in the second-degree, criminal possession of a firearm, second-degree reckless endangerment, endangering the welfare of a child, third-degree assault, fourth-degree criminal possession of a weapon, and possession of ammunition.
According to the investigation, on Nov. 4, 2021, Ball allegedly fired one gunshot after getting into a dispute with another man. The bullet struck the victim in the leg as she walked down West 225th Street in the Marble Hill section of the Bronx.
The case is being prosecuted by assistant district attorney, Katerina Kurteva and assistant district attorney, Melissa Zacharias, both of trial bureau 70, under the supervision of Jessica Lupo, deputy chief of trial bureau 70, and under the overall supervision of James Brennan, deputy chief of the trial division, and Theresa Gottlieb, chief of the trial division. Clark thanked NYPD Detective Paul Sullivan of the 50th Precinct Squad for his work on the case.
The defendant is due back in court on March 18, 2022. A person charged with a crime is innocent unless and until convicted in a court of law.
